Idaho Probation: know about it
A criminal may be given a reprieve in form of probation instead of a jail sentence. This is usually pronounced by the judge in an Idaho Court of Law. The jury does not get involved in case of probation. The individual is usually observed by the Probation officer at all times and enjoys very limited freedom. The frequency of supervision by the probation officer depends on the criminal record of the individual. It is usually done to show faith in the person and to prove that the person is not a habitual criminal but has been compelled by circumstances.
Idaho Probation Laws
The law of the state of Idaho requires the person on probation to behave like a good citizen at all times. He must comply with all the terms laid down by the State and cooperate fully with the Probation officer. If the accused finds that he is unable to do so, he must be completely honest in his communications and state his problems clearly. Inability to pay the fines imposed must also be explained satisfactorily to the Probation Officer in charge. The court must be informed of any change of address within 48 hours.
Idaho Violation of Probation
The court sends out an order for re-arrest of the accused on probation if he/she violates any of the terms for probation. The court may also decide to revoke his probation if the behavior of the defendant is found to be unsatisfactory.
Idaho Transfer of Probation
The probation officer may ask for similar supervision of the accused from another state jurisdiction. However, the person cannot move out of Idaho until and unless the case for transfer has been accepted. Exceptions may be made if the criminal originally belongs to another State. The Idaho probation officer must be informed of the criminal’s intention to transfer at all times otherwise it may cause a violation of the probation law.
Idaho Probation Officers
The Idaho Probation officers normally comprise of the employees of the district court or the Federal Law enforcement officers. They try to observe and supervise the people who have been placed under probation by the State of Idaho. These officers try to eliminate the risk to society by trying to rectify the behavior of these offenders. The officers ensure that they follow the terms of probation rigorously. They are also entrusted with releasing the offenders into the community after their term ends.
Due to the highly sensitive nature of their jobs, these officers have their backgrounds thoroughly checked. The court appoints them only if they can clear the high standards set by the State of Idaho.
Early termination of Probation
The accused may request for a hearing if he wants an early release from probation. The court may agree to an early hearing and early termination of the probation only if the probation officer is satisfied that the criminal has been reformed by the probation.
Idaho Probation Records
Idaho Probation records include attempted crimes and conspiracies against the State of Idaho. The information is given out by the Idaho courts to the departments of corrections. However, the whereabouts of the offenders placed under probation are not disclosed to the public as these are part of the official criminal records.
