Pennsylvania Probation is granted to those people who have committed crimes such as felony, misdemeanor, substance abuse and others. The offender is generally sentenced to imprisonment terms with fines and penalties. However, if the offender applies to the court for probation the court may judge the circumstances and grant him with a probation order that will enable him to live a free life away from the confinement of the jail.
The probation is basically granted in order to enable the offender to get back a normal and better life. However the probation comes with a lot of restrictions and activities that the offender must abide by completely. Failing to put up with all the terms and conditions of the probation can make him serve the jail sentence or even get a harsher punishment. This will depend upon the intensity of the violation.
Pennsylvania Probation: General Conditions
The terms and conditions of Pennsylvania probation are same as that set by the Federal law. However the court may put up further restrictions depending on a particular case. The probation is generally of two types. The supervised probation entails the offender to report to the probation officer once in a month or more. Whereas, the unsupervised probation, known as the Court probation, where the person does not require reporting to the probation officer. But if it is required the probation officer can visit his premises for evidences of violation of probation.
The general conditions of Pennsylvania probation include similar restrictions like that in the other states under the federal law. The Pennsylvania probation law states that the offender cannot leave the state without prior permission of the Court or the Probation Office. He should also pay the fines or penalties in due time.
During the probation if the offender gets arrested or commit a new crime then he must report it to the probation office within 72 hours. The offender must also inform the arresting officer that he is on probation. If any enforcement agency investigates the offender then he should report this to the probation office.
Pennsylvania probation states that the offender cannot possess any fire arms or harmful weapons that may cause harm to him or others. This can be a special condition if the offender has been charged with felony. Keeping of illegal drugs is also prohibited. The offender is also prohibited from the usage of alcohol during the probation. The probation officer may call the offender for drug and alcohol tests anytime they wish.
The offender will be required to live a peaceful life and not involve himself in any kind of overt behavior that may threaten others. Violation of these conditions can have severe consequences. The offender will be sent to jail once again for violation of the probation.
Pennsylvania Probation: Special Condition
If the offender has a special condition on his probation then it becomes essential for him to abide by that rule thoroughly. The particulars of the special conditions get reviewed by the probation officer during the interview.
