The Division of Criminal Investigation is mandated by the State of South Dakota, to establish and maintains a registry of convicted sexual offenders living in South Dakota, under the South Dakota Criminal Law (22-22-31 through 22-22-41). The sex offender registry keeps the track the location of a class of offenders that, by nature of their crimes, pose an ongoing risk to public safety. The South Dakota Sex Offender Registry (SOR) responsibility was assigned to the ID Section since its creation in 1994 because it is fingerprint supported information. Other than these manual files, the South Dakota’s SOR is completely automated. The information from this directory is available to the general public.
The registration law for Sex Offenders was amended in 1995, so anyone residing in South Dakota with a felony sex crime conviction, including out-of-state or federally-convicted sex offenders, has to register for their lifetime. Juvenile registration is not for life, and they must be fifteen years of age or older. Juvenile can be removed from the sex offender registry, by a court order after 10 years of registration. All individuals convicted of serious sex crimes that are no longer imprisoned, must register if residing in South Dakota for more than thirty days. The sex offenders, who are convicted sex, must register with the local police department or sheriff’s office in their area. Whenever an offender moves from an address, he or she has ten days to notify law enforcement agencies of the change of address.

The individual requesting for the data about the offender must clarify his or her concern for the required information about the sex offender. The South Dakota Registry will than provide the information according to the normal or high priority notifications.
If error(s) found in the South Dakota Sex Offender Registry, it should be directly intimated to the local law enforcement agency. The registry will then scrutinize the errors and change the information in case of correction needed. If in case, the sex offender is found to be living in an area and is not registered in the sex offender registry of South Dakota, this should also be informed to the law enforcement agency where the sex offender is listed as residing or the law enforcement agency where the offender is actually living.

Online South Dakota Sex Offender Registry: the sex offender information is available at the South Dakota website for sex offenders. The offenders can register directly or any individual from the general public interested in the information can also access it through the online source. Any misuse of the information provided by the South Dakota’s sex offender registry will be considered as a civil or criminal offence against the Law of South Dakota. Any Sex offender who fails to register or update address information will be charged with a misdemeanor and subsequent compliance violations are felonies.
